TERMS AND CONDITIONS

1. Scope and Provider

These Terms and Conditions apply to all orders placed through the online shop operated by:

Customers within the meaning of these Terms and Conditions may be consumers or businesses. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or independent professional activity.

2. Conclusion of the Contract

The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order.

The customer may initially place the selected products in the shopping cart and may review and correct the information entered at any time before submitting the order.

By clicking the button that completes the ordering process, the customer submits a binding offer to purchase the products contained in the shopping cart.

The purchase contract is concluded as soon as we expressly accept the order by email or dispatch the ordered goods, whichever occurs first. An automatic order confirmation sent immediately after receipt of the order does not constitute acceptance of the offer unless acceptance is expressly stated therein.

3. Products and Product Representations

The characteristics of the products are determined by the respective product description in the online shop.

Many LUCKYNELLY products are handcrafted using innovative, plant-based or other novel materials. Minor variations in texture, surface, colour, grain or craftsmanship may occur due to the materials or manufacturing process and emphasise the individual character of each product. This does not affect the agreed characteristics of the product or the customer’s statutory rights in the event of defects.

The appearance of colours may differ slightly from the actual product due to different screen settings.

4. Prices and Payment Terms

All prices stated in the online shop are total prices in euros and include statutory value-added tax where applicable.

Any additional shipping costs will be displayed to the customer in the online shop or during checkout before the order is submitted.

The payment methods displayed during checkout are available. Payments may be processed by external payment service providers. The terms and conditions of the selected payment service provider may also apply.

Unless otherwise stated for the selected payment method, the purchase price is due immediately upon conclusion of the contract.

5. Delivery and Shipping

Delivery will be made to the delivery address provided by the customer during the ordering process.

The available delivery countries, shipping methods, shipping costs and estimated delivery times are displayed in the online shop or during checkout.

For products that are manufactured only after the order has been placed, the delivery time consists of the production time stated on the product page plus the subsequent shipping time.

If delivery is significantly delayed, we will inform the customer without undue delay.

In the case of consumers, the risk of accidental loss of or accidental damage to the goods generally passes to the consumer only when the goods are handed over to the consumer or to another person authorised by the consumer to receive them.

6. Retention of Title

The delivered goods remain the property of LUCKYNELLY GmbH until payment has been made in full.

7. Right of Withdrawal

Consumers generally have a statutory right of withdrawal.

Details regarding the conditions, deadlines, exercise and consequences of withdrawal are set out in the separate Right of Withdrawal Policy available in the online shop.

The right of withdrawal does not apply, in particular, to contracts for the supply of goods that are not prefabricated and for the production of which an individual choice or decision by the consumer is decisive, or that are clearly tailored to the consumer’s personal needs.

The mere manufacture of a product after receipt of an order from standardised models, colours or versions does not automatically exclude the right of withdrawal. The statutory requirements and the specific design of the product are decisive.

The statutory consequences of withdrawal, including any obligation to compensate for diminished value, are governed by the Right of Withdrawal Policy and the applicable statutory provisions. Use of the original packaging is not a requirement for the valid exercise of a statutory right of withdrawal.

8. Statutory Rights in the Event of Defects

The statutory rights in the event of defects apply.

If the delivered goods are defective, the customer is entitled, in particular, to the statutory remedies of subsequent performance and, where the statutory requirements are met, a price reduction, withdrawal from the contract or damages.

An additional guarantee applies only where it has been expressly granted for the respective product.

9. Liability

LUCKYNELLY GmbH is liable without limitation:

– in cases of intent and gross negligence;
– for damages resulting from injury to life, body or health;
– in accordance with the provisions of the German Product Liability Act;
– within the scope of any guarantee expressly assumed; and
– in all other cases in which a limitation of liability is excluded by law.

In the event of a slightly negligent breach of a material contractual obligation, liability is limited to the foreseeable damage typical of the contract. Material contractual obligations are obligations whose fulfilment is essential for the proper performance of the contract and on whose observance the customer may ordinarily rely.

In all other respects, liability for damages caused by slight negligence is excluded.

The above liability provisions apply accordingly to the legal representatives, employees and agents of LUCKYNELLY GmbH.

10. Copyright and Other Intellectual Property Rights

The designs, photographs, videos, texts, graphics, logos, product designs and other content displayed on the website are protected by copyright or other intellectual property rights.

Any use, reproduction, editing, publication or distribution beyond what is permitted by law requires the prior consent of the respective rights holder.

11. Consumer Dispute Resolution

LUCKYNELLY GmbH is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

12. Governing Law

The law of the Federal Republic of Germany applies, excluding the United Nations Convention on Contracts for the International Sale of Goods.

In the case of consumers, this choice of law applies only insofar as it does not deprive the consumer of the protection afforded by mandatory provisions of the country in which the consumer has their habitual residence.
